2. Mandatory Disclosures (POPIA Section 18)
Purpose: Data is collected primarily to facilitate social networking, video sharing, and account security.
Voluntary vs Mandatory: Providing your name and age is mandatory to create an account. Providing a profile picture is voluntary.
Consequences of Non-provision: Failure to provide mandatory data will result in the inability to register an account.
3. Cross-Border Data Transfers
We host data on Amazon Web Services (AWS) servers located outside South Africa. In compliance with Section 72 of POPIA, we ensure these third parties are subject to laws or agreements that provide a level of protection substantially similar to POPIA.
4. Special Personal Information (Children & Biometrics)
While we restrict access to users aged 13+, we acknowledge that under SA law, users aged 13–17 are still "children." By using this app, the user (or their guardian where applicable) provides competent person consent for the processing of their data. We do not process "special personal information" (like religious beliefs or health data) unless explicitly permitted.
5. Direct Marketing
We will only send direct marketing communications (via email or SMS) if you have opted in, or if you are an existing customer, in accordance with Section 69 of POPIA.
6. Your Right to Lodge a Complaint
You have the right to lodge a complaint with the South African Information Regulator if you believe we have interfered with the protection of your personal information.

7. Security Safeguards
We maintain "appropriate, reasonable technical and organizational measures" as required by Section 19 of POPIA to prevent unauthorized access or loss of personal data.
TERMS OF USE
1. Eligibility & Age Restrictions
You must be at least 13 years old. For users under 18 (minors), South African law requires that a "competent person" (parent or legal guardian) provides consent for the processing of personal information. By using this app, you warrant that such consent has been obtained.
2. POPIA & Personal Information
As a South African responsible party, we process your personal information in accordance with the Protection of Personal Information Act (POPIA):
Purpose Specification: Data is collected solely for profile management and service delivery. We do not sell data to third parties.
Information Officer: You may contact our Information Officer for any data access requests or corrections on admin@agileafricaventures.com.
Operator Agreements: Our use of Amazon (AWS) as a cloud partner is governed by Section 21 of POPIA, ensuring they maintain the same security standards we do.
Data Subject Rights: You have the right to object to processing, request deletion, or lodge a complaint with the Information Regulator (South Africa).
3. Transborder Data Flows
In accordance with Section 72 of POPIA, your data may be transferred to servers hosted by Amazon outside of South Africa. We ensure these jurisdictions have data protection laws or agreements that provide an adequate level of protection substantially similar to POPIA.
4. Disclosure under ECTA
As required by the Electronic Communications and Transactions Act (ECTA), our full registered name, physical address, and contact details are available in the "About" section of the app and in the “Contact” section of our website. You have the right to cancel transactions for services as specified in Section 44 of the ECTA.
5. Content & Conduct
Users must comply with the Cybercrimes Act of 2020. Distribution of harmful data messages, incitement of violence, or cyber-fraud will result in immediate termination and reporting to the South African Police Service (SAPS).
6. Consumer Protection Act (CPA)
These terms are drafted in plain language to comply with the CPA. Any limitation of liability or indemnity contained herein is brought to your attention specifically as it limits your rights.
7. Governing Law
These Terms are governed by and construed in accordance with the laws of the Republic of South Africa. Any disputes will be subject to the jurisdiction of the South African courts.
